Divorce, custody and child welfare: a review of research in psychology

SUMMARY
custody of children after divorce is the main area of \u200b\u200bintervention of Legal Psychology. Factors influencing the child-welfare principle in the actions of Justice, are numerous and must be analyzed in each case, but this does not preclude the necessary support in previous investigations. In this paper we review the available research data about the differential effects between the individual and joint custody. Most results indicate that, other things being equal, joint custody is more beneficial to the welfare of the individual child, both by direct effects on their behavior and emotions, as indirect through reducing conflict between parents. A number of studies found, however, that any type of custody is more beneficial than the other for the child.

This work reviews the available empirical data on the differential effects between shared and sole custody. A majority of researchers have found that, other factors being equal, shared custody provides more benefits for the child well-being than sole custody, with a direct effect on the child behaviour and emotions and also with an indirect effect through the reduction of parental conflict. Notwithstanding, a high number of studies have not found any difference between both types of custody.

INTRODUCCIÓN
Durante el año 2006 se dictaron en España 126.952 sentencias de divorcio, representing an increase of 74.27% over the previous year and no less than 223.51% over five years earlier. Of all divorces in 2006 in 53.80% of cases was involved the custody of children, which taking into account the number of children per marriage broke a total of 93,481 affected children (source: INE, see www.ine.es). And although the National Institute of Statistics does not provide data on who is assigned custody, it does say who is paying maintenance, which can be taken as a reference: in 92.6% of cases the father, compared to 2.9% mothers and 4.43% of cases where those who pay them.

As stressed in the caselaw, the fundamental principle that must govern the determination of the guardianship and custody of children is the protection of children, or please fili, while recognizing that parents also have the right to interact with their children. For such opinions, the experts have protocols of action that included a detailed assessment of the circumstances that come together in each case, and certainly the result of such evaluation should be one of the most important factors facing the final decision regarding the type of custody that the child will provide more welfare . However, as in any other area, it is clear that the views, procedures and judgments of the experts must be linked to the results of research in this field, but should rather be supported by them. In Spain, the "boom" of divorce is still relatively new to provide a solid body of research, but in other countries around us Reference is now widely available empirical knowledge that can transcend mere opinions, especially on this topic, primarily based on moral and ideological judgments.

STUDIES ON CHILD CUSTODY AND WELFARE

Effects of sudden separation from a parent about the child's emotional well

The sudden absence of a parent for long periods causes significant emotional distress less, unable not only to understand all aspects of the situation, but also to define the role he is playing in it. One child used to be with both parents regularly and to experience such contacts as a source of support, love and understanding, can react to the absence of one of them in the short to medium term, with a behavioral pattern characterized by aggression, desperate attempts to regain the love that lives as lost, anxiety , irritability, emotional instability, regressive behaviors, feelings of inferiority and guilt, self-injury, workplace problems and depression (eg, Amato and Gilbreth, 1999; Emery, 1994; Kalter, 1990; McLanahan, 1999, McLanahan and Sandefur. 1994; Wallerstein. 1991).

The difficulties of noncustodial parents to contact and interact with their children can be aggravated by the emergence in these attitudes of rejection towards them unjustified, promoted from the living environment, establishing the so-called Parental Alienation Syndrome (PAS), destructive effects (Aguilar, 2004; Ramírez, 2004). As pointed out by Assumption Weaver, coordinator of Legal Psychology of the College of Psychologists of Asturias, the SAP is a very common reality, and "90% of cases is alienating the custodial" (cited in Fernandez, 2007) .

Influence of the type of custody over the child's

Most research finds that joint custody compared with sole custody, is a better fit for children in a variety of measures. This is demonstrated, among others, the studies cited below (for each study cited reference, sample and main results).

emphasize in this regard the comprehensive meta-analysis by Amato and Keith (1991) and more recently by Robert Bauserman (2002). In the latter study, Bauserman analyzed all empirical studies on the subject conducted between 1982 and 1999, including in major scientific databases in the United States. Of these, selected the 33 studies that met the criteria sufficiently objectivity and methodological correctness, including 21 doctoral theses. The conclusions were clear: "From the results, children at joint custody are better adjusted, as revealed by all measures, than children in mother sole custody situation "(p.97)," joint custody may be beneficial for children in a wide variety of domains, family, emotional , behavioral and academic "(p.98)," the best fit associated with joint custody does not vary with the age of the child "(p.98), and even" the setting is the same on that joint custody intact families "(p.98).

Finally, we will cite only two studies in our review, show different results. So, Hendrickson (1991) found that although generally lower in custody showed better psychological adjustment, this was more evident in girls, while boys tended to show better adjustment individual in custody. And Buchanan, Maccoby and Dornbusch (1992) suggested that joint custody is a setting similar to that of maternal custody, and in both cases higher than parental custody.

Influence of the type of custody to the degree of conflict between parents

Pearson and Thoennes (1990) even found that while 50% of parents and 30% of mothers in sole custody situation positively valued the parenting style of his former spouse, the percentage rose to 65% in custody case shared.

Within this section, we note that several studies identified the existence of a high level of conflict between the parents as the primary (if not the only) obstacle to that joint custody is the best situation for children whose parents have divorced (eg Johnston 1995, Johnston et al., 1989, Wallerstein & Johnston, 1990). However, in his comprehensive review of research, Robert Bauserman (2002) concluded that this only applies to cases where the level of conflict is extreme.

Influence of the type of custody in the degree of adjustment of the parents

There are some who believe that parents need to rebuild their lives after separation, and that the obligation to see the other quite often difficult or impossible task. It was suggested that the parent with sole custody may experience feelings of overflow by increasing the work overload, social isolation, requirements for home care and care of children (Canton, Cortes and Justice, 2000, Rincón and Marrero , 2000). Several investigations did not support neither approaches. So on the one hand it has been found that the level of estrangement between the parents (measured at the time of separation and a couple of years later) tends to increase regardless of the type of custody that is agreed (Pearson and Thoennes, 1990 .) On the other hand, research found there is no relationship between type of custody and adjustment of the former spouses, measured in coping skills, social relationships, job performance, satisfaction with life stress or job satisfaction (Bailey, 1991; Coysh et al. 1989, Maccoby and Mnookin, 1992, Shapiro and Lambert, 1999).

CONCLUSIONS We began by saying that in 2006 a total of 93,481 English children were faced with the divorce of their parents. The welfare of each and every one has depended, in each case, numerous factors: the level of conflict between parents before and after separation, parental adjustment to divorce, the degree of closeness between child and parent, the child's personality, sex and age, pre-divorce adjustment, attitudes and performance of the parents in their upbringing and care, socio-economic circumstances of each of the parties ...

The vast majority of these children live today on a regular basis with the mother, limiting their contact with the father at a rate of "hits" more or less reduced, which in most cases results in four nights month. A small group of children, however, share their time, activities and care equally with his father and his mother. Others being equal individual factors that come together in each case, it is time to ask, which of the two types of custody is "adequately protected the interests of the child" as required by our Civil Code?

Research tells us that joint custody is more beneficial than sole custody, to the extent that (a) minimizes the potential negative effects of sudden separation from a parent, (b) improving the quantity and quality links between the child and parents, (c) is a better fit of the child, measured with a wide variety of indicators, and (d) reduce the degree of conflict between former spouses, which in turn reverberates indirectly in the child's welfare. The research that has deferred these results have raised almost entirely to a lack of influence of the type of custody over the child's welfare.

In recent years, the accumulation of results has led to a clear bias in favor of joint custody between practitioners and academics in psychology. But not only psychology professionals share this view, but also a growing number legal experts. Summary

This allows the use of unbiased techniques in the evaluation of hits and false alarms and standardized distributions obtained for each experimental condition. The results confirm differences in recognition memory due to experimental exposure time, the type of speech and other pre-experimental effects. These data are consistent with models of familiarity and recollection when we use the frequency of use of words and models of familiarity, recollection and dual-route when we use words organized by class. Finally, it argues for a model of interactive processing (words arranged by frequency) versus a processing model closer to the modularity (words organized by class).

ROC and z-ROC parameters in word memory: experimental and pre-experimental effects. In this study, ROC and z-ROC parameters are applied in word recognition memory, with words classified according to frequency and class. In doing so, unbiased techniques can be used to assess hits and false alarms and to obtain standardized distributions for each experimental condition. Our results confirm the existence of differences in word recognition memory for experimental exposition time, type of words and other pre-experimental effects. These data are consistent with familiarity and recollection models when words’ frequency of use is utilized, and with familiarity, recollection and dual-route models when words are organized according to class. Finally, we argue in favour of an interactive processing model (Organized According To frequency words) versus processing model near to modularity (words Organized According To class).

Drawing on the evolutionary models of ethno-racial consciousness, perceptions are discussed in this field that show two groups Children: English white (N = 176), and children of Moroccan origin living in Spain (N = 63), all enrolled in the corresponding levels at 3, 4 and 5 years of age. For this purpose several photographs of models of the so-called traditional white, black, Chinese and Arabic, to which participants must indicate whether there are any who are alike more (identification task), one they like better (preference) and some they like less (rejection). The results included a linear increase in identifying "correct" earlier among children of Moroccan origin from the English, the white model is preferred by all participants, with black and Chinese the most rejected. We discuss the methodological and social implications of these results.

Using the Developmental models for the ethnic-racial conscience as a reference, we analyze the Perceptions of two groups of children: English white children (N=176) and children of Moroccan origin who live in Spain (N=63). All of them attend to classes in English public schools, in levels corresponding to 3-5 years of age. We use several photographs of models belonging to what has been traditionally called white, black, Chinese and Arab races. The task of the participants is to indicate if any of the models resembles more to him or her (identification task), if he or she likes more any of the models (preference) and if he or she dislikes more any of the models (rejection). The results reveal a lineal increase in the "correct" identification, which appears before in the children of Moroccan origin; the white model is preferred by all the participants, and the black and Chinese models Rejected Are The MOST frequently. The social and Methodological Implications of These Are results discussed.

Summary
Considered by many to be the characteristic disorder of the XXI century, in recent decades, stress has become an object of attention by an increasing number of instances - media institutions educational, business, government and general public. The feeling of being "overwhelmed" is manifested in almost all areas of life, each of which has a history, characteristics and particular consequences. This paper focuses on one of these areas: labor. Based on a review of the presence of such stress in our society, epidemiology, estimated consequences on people and companies, "discusses the key factors involved in the development and maintenance of the problem, and explains the basic working on prevention, detection and eradication.

Abstract
Considered by many as the most characteristic disorder of the 21st century, in the last decades the stress has received a growing attention from an increasing range of instances: mass media, educational institutions, business corporations, authorities and citizens in general. SUMMARY
If something seems to be characterizing this century that has just begun, is the phenomenon of immigration. A global phenomenon that is pervasive and affects us all, and yet we are giving partial and contradictory answers. In Spain, many foreigners currently reside studies college, obtained here or in their home countries, where the points of view to the job search are not the same as those of college English or foreigners with low qualifications. This paper reviews several reports on three aspects of the issue: (a) presence of immigrants in Spain, in general, (b) foreigners in the English educational system, and (c) foreign immigrants with university degrees obtained in their country of origin. Following the presentation of quantitative data, it will now examine the particular features which contribute to the various groups of immigrants and foreigners with a university education, the obstacles that each found and the potential benefits of face to their employment, focusing on issues such as recognition of qualifications, obtaining work and residence permits, lack of information from immigrants themselves, the rejection of immigrants by many people the host society, and lack of information and prejudices of employers and human resources managers. Finally, we suggest some possible courses of action to improve the employability of these people.

Summary
A large number of authors defended the need for an integrated approach to increasing intercultural reality of societies like ours. From a literature review, we designed a questionnaire with 29 items referring to some of the proposals arising from this approach, and ask a sample of 52 primary school teachers who work in public schools in Algeciras (Cadiz), which indicate for each item, the degree to which they consider relevant and the extent to which they apply in their daily work and in its center. Results show that while teachers value most positively proposals encounter serious difficulties in applying in practice a number of them. The data are discussed in relation to sex, age, experience, intercultural training of teachers, and the percentage of foreign pupils in each case.

A large number of Researchers Defend the Need of an integrative view on the growing intercultural reality of Societies Such as ours. After a bibliographic review, we designate survey with 29 items including some of the Proposals That Have Been Suggested from this paradigm. A sample of 52 teachers of primary education from public schools in Algeciras (Cádiz) was asked to indicate the degree in which he or she considered that each item was relevant and the degree in which it was applied in his or her daily practice. The results reveal that, although a majority of the proposals is rated as highly convenient, the teachers find it highly difficult to implement some of them. The data are discussed per gender, age, teaching experience, training in interculturality, and percentage of foreign students.

Abstract Examines the short-term effect of an event particularly relevant (a major terrorist attack) on the attitudes of 96 English adolescents from the province of Cadiz for three social groups: Moroccans, Muslims and immigrants. These groups show a remarkable overlap, but can not be objectively identified with one another. Questionnaires were applied on two occasions: during a period without significant events that would affect the group in question, and a few days after a major terrorist attacks blamed on Muslim fundamentalists. Responses cognitive, behavioral and emotional to the three groups were very similar before and after the attacks, and changed in the negative after them.

Abstract This Study examined the short-term effect of a major event (Terrorist Attacks) on the Attitudes of 96 English adolescents Who live in the English province of Cadiz Towards three social groups: Moroccans, Moslems and Immigrants. The questionnaires were administered two times: during a period without relevant incidents related to any of the target groups, and a few days after a big terrorist attack which was attributed to Moslem reactionaries. Adolescents' cognitive, behavioral and affective responses towards the three groups were similar, both before and after the attacks, and changed in a negative direction after the attacks.

Video games are one of the most common forms of entertainment in our society. Many people, mostly young, but not only them, have any console games used computer, go to the arcades to play, buy magazines, and, finally, spin their leisure time on this new form of entertainment. The game industry moves every year millions of euros, employing thousands of people and creating a network of business interests that only a few decades ago was unimaginable. Advertising campaigns on video games have jumped from more properly means "childish" to those others that involved the majority of society, such as television and football. In a century with more leisure time than we have ever enjoyed and technological capacity limits unpredictable, some people and adventure that the game will soon overtake television as the great medium of entertainment in the developed world.

The counterpart of this thrust is found in those parents, teachers and citizens, who feel overwhelmed by an environment that neither know nor understand. The interests of any kind that move around the game regularly promote controversy over the "good" or "bad" they are. Discussions without a clear conclusion, which often raised questions rather than providing answers. The very appearance of the first games in the early 70's was accompanied by many voices predicted that youth would end soon turned into automatons lonely and violent. Since then the games have changed dramatically, incorporating not only better graphics and sound effects, but also new issues, bulky peripheral devices and new media (like portable consoles or computer games). However, critics remain largely unchanged. In full year 2002 are still many who ask what are the appropriate attitudes that we must keep to the use of video games for children? Do we know? Should we accept? Should we control? Are they as negative as they seem? Do they generate addiction? "Cause aggression? "Socialize or isolate? How long can our children play? ...

Since 1996, the Department of Psychobiology and Methodology, University of Manchester have developed a thorough investigation to find answers to many questions and such. Over six years, we dive into the databases and libraries, interviewed hundreds of users of video games collect information from dozens of researchers and systematically analyze the available data. It is not possible to summarize in these pages the results of such research (see "Video games: what they are and how they affect us," Ed Ariel, Ariel Social Library, in press), but we can present some suggestions that we believe may be useful for all those concerned by this phenomenon.

First, it must cope with extreme caution in the news, often alarmist, which usually haunt this form of entertainment. Many of the arguments (for or against) are based more on prejudice or other commercial interests rather than scientific data, and even in this case can one or two isolated studies to allow firm conclusions. Moreover, it is recalled that the negative news get more attention from the media than positive. For example, many heard about the "murderer of the Katana" certain violent video game fan, but few who know Bronkies, the dinosaur that makes it easier for children 6 to 16 years to overcome their problems with asthma.

There is some evidence to associate certain types of games and games with aggressive behavior or the commission of illegal activities, and no shortage of those who suggest that video games can be a gateway to the "gambling." However, there are numerous studies showing how video games can improve certain perceptual abilities, how they can be used effectively in education and health promotion, or how they are used successfully to introduce youngsters to the world computer science or practice of other games, like chess. Without doubt, should know not only the potential dangers, but also the potential benefits of them can be removed before taking a more or less dogmatic and ultimately to a reality as new.

Video games are very well designed to attract our attention and interest the same so that advertisements are thoroughly studied. In this sense, the players are attracted by the quality of graphics, speed of visual action, sound effects, verbal reinforcement, interactivity, the activity of "achievement", the credibility of content, the existence of a random component, the immediate feedback and the possibility of surprises, among many other aspects. And when we tried to children, adolescents, perhaps, to remember their natural tendency to enjoy without measure everything that they find it enjoyable ... although adults may seem harmful.

Does this mean that parents must control the use of video games for their sons and daughters? We answer yes, and we hasten to clarify that in the same extent that they must "control" any other activity, and always starting from a certain knowledge of it. It is necessary that parents help their children to properly distribute their time, encouraging them to perform other activities like sports, reading, listening to music or just play with friends (all of it "in its proper measure.") For it must be adequately informed, to know what games used, talking to their sons and daughters and, why not play with them somewhere. Advantage and to show with your own behavior, which is no fun odds with the serenity and time management. We think that in a family "healthy" in that relations are based on the support and affection, it is unlikely that games come to produce any negative effect.

Obviously, all of this requires time and effort that many parents will not or can not use. But perhaps it is time to assume full responsibility that comes with being a parent, rather than being driven by the increasing tendency to delegate the "burden" in other fora such as school and government.

Key findings include the lack of studies focusing specifically on video game addiction and major shortages in much of the research. No study makes explicit the addiction model of that part, and the concepts used are often not adequately explained. Most works are based on general surveys of questionable validity and reliability, while others focus only on certain types of machines, so their results are hardly generalizable. Not have a valid and reliable diagnosis this alleged addiction, and the proposed adaptations are not applicable to all gaming systems or unknown psychometric properties. Most of the studies reviewed tend to be noted that for some subjects, the use of video games is a problem. However, current knowledge does not allow to determine the nature and origin of the problem. Video game addiction Seems To Be A Widely Accepted disorder. This critical work in a Manner reviews the literature and the state of the art about this topic. The Scarcity of works Focused specifically on video game addiction, as well as the weakness of many of the investigations are commented as main conclusions. None of the studies makes explicit the model of addiction that constitutes its reference, and concepts are only seldom appropriately explained. Most of the works are based on general surveys of doubtful validity and reliability, while others are focused only on certain types of video machines, thus limiting the generalisation of their results. No valid and reliable diagnostic system is so far available to measure that presumed addiction, and the adaptations that have been proposed are not applicable to all video game systems or their psychometric properties are unknown. Certainly, a majority of works report that, for some subjects, video game use constitutes a problem. Nevertheless, the nature and the possible origins of this problem remain as unsolved questions. Finally, possible lines for future work are reviewed.

Abstract
Aims: Some researchers suggest that for some people, video game playing is an addictive behavior similar to substance dependence. Our aim was to design and validate a scale to measure the problems associated with the apparently addictive use of all types of video games and video game systems, since there is no instrument at the present time that can be used for this purpose. Design: We reviewed the DSM-IV (APA, 1994) criteria for substance dependence and for pathological gambling, as well as the literature on the addictions in order to design a short scale (PVP; Problem Video Game Playing) that is quick and easy to apply. Participants: The scale was administered to 223 English adolescents aged between 13 and 18 years. Findings: Psychometric analyses show that the PVP seems to be unidimensional and has acceptable internal consistency (Cronbach's alpha) at .69. The pattern of associations between the scale scores and alternative measures of problem play supports its construct validity (higher total scores in the scale were associated with higher frequency of play, mean and longest times per session, self and parents perception of playing to excess, and scores in the Severity of Dependence Scale). Conclusions: Our results confirm that the excessive use of video games is associated with a number of problems which resemble a dependence syndrome, and the PVP appears as a useful instrument for the measurement of such problems.
